Terms and Conditions

⚠ DRAFT — These Terms are a working document and must be reviewed by a lawyer before taking effect.

1. Scope

These Terms and Conditions apply to all contracts between Scaliir Digital UG (haftungsbeschränkt), hereinafter "Platform Operator", and users of the Laufbursche platform (customers, workers, and businesses). By registering, you accept these Terms.

2. Service Description

Laufbursche is a brokerage platform for local jobs. The Platform Operator enables customers to assign jobs to local workers and businesses. The Platform Operator is not a party to contracts concluded between users. Contractual relationships exist exclusively between the respective users.

3. Registration and User Account

Using the Laufbursche platform requires registration. Users must be at least 18 years old and have full legal capacity. Information provided at registration must be truthful and complete. Each user is responsible for the security of their access credentials.

4. Roles and Obligations

Customers: May create orders and purchase products. Workers: Are self-employed contractors, not employees of the Platform Operator. They perform jobs on their own account. Businesses: Sell products and services via the platform and are responsible for proper fulfillment.

5. Self-Employment of Workers

Workers act as self-employed entrepreneurs. There is no employment, service, or similar relationship with the Platform Operator. Workers are responsible for their own tax and social security obligations. There is no minimum acceptance obligation; nor is there any obligation to accept offered jobs.

6. Compensation and Payment Processing

Payment processing is handled via Stripe Connect. The Platform Operator retains a brokerage fee, the amount of which is transparently displayed in the app. Payouts to workers and businesses are made via the respective Stripe Connect account.

7. Cancellation and Refunds

Cancellations are possible according to the conditions displayed in the app. For jobs already in progress, prorated cancellation fees may apply. Refunds are made via the original payment method.

8. Ratings

Users may rate each other. Ratings must be truthful and objective. Inadmissible or illegal ratings may be removed by the Platform Operator.

9. Liability

The Platform Operator is liable only for damages caused by intent or gross negligence, as well as for damages from breach of essential contractual obligations. Liability is limited to foreseeable, contract-typical damages. The Platform Operator is not liable for the content, services, or availability of jobs, products, and workers.

10. Termination

You may terminate your user account anytime in the app under Settings → Delete Account. The Platform Operator reserves the right to suspend or delete user accounts in case of violations of these Terms.

11. Changes to Terms

The Platform Operator may change these Terms with effect for the future. You will be informed of changes by email or push notification. If you do not object within 30 days, the new Terms are considered accepted.

12. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction for disputes with businesses is Frankfurt am Main. For consumers, statutory regulations apply.

13. Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. The Platform Operator is not obligated to participate in dispute resolution proceedings, nor does it participate.

14. Severability Clause

Should individual provisions of these Terms be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the statutory regulation.
